Walletap Terms of Service

Last updated: 2 October 2026

These Terms of Service (the "Terms") are the agreement between you and Walletap d.o.o. for the use of Walletap. They cover the website, the dashboard, the Walletap apps and paid plans, including plans bought in the mobile app.

For accounts created on or after 29 September 2026 these Terms apply from sign-up. For accounts created earlier they apply from 29 October 2026; until then the previous version applies to those accounts. The last sentence of 3.4 and section 5.6 apply to every account from 1 November 2026.

1. About these Terms

1.1. Walletap is provided by Walletap d.o.o. za računalno programiranje, Nazorova ulica 60, 52100 Pula, Croatia ("Walletap", "we", "us"). Our full company details are in section 26.

1.2. These Terms apply to all of the following (together, the "Service"):

  • the website at walletap.com and the dashboard at app.walletap.com;
  • the Walletap apps for iPhone and iPad, Android (from Google Play and Huawei AppGallery), Windows and macOS;
  • the Walletap API, the Walletap MCP server and integrations that connect to them;
  • the pages we host for you, such as sign-up pages, pass pages and membership pages.

1.3. You accept these Terms when you create an account or continue past a screen that says that continuing means you accept them, or when you use or buy any part of the Service. If you do not accept them, do not use the Service.

1.4. The Service is made for businesses: shops, cafés, gyms, salons, coworking spaces and other organisations that issue cards to their customers or members. If you accept these Terms for a company or another organisation, you confirm that you are authorised to bind it, and "you" means that organisation. You must be at least 18 years old. If you use the Service as a consumer, section 21 also applies to you.

1.5. If you have a signed agreement, order form, data processing agreement or service level agreement with Walletap, it prevails over these Terms where the two differ. A partner or reseller who sold you Walletap cannot change these Terms. Their promises bind Walletap only if they appear in these Terms or we confirm them in writing.

2. Words we use

  • Account: your Walletap account, with everything in it: companies, locations, card designs, passes, members, team members and settings.
  • Owner: the person who created the Account, or to whom it was handed over. Only the Owner can buy, change or cancel a plan.
  • Team members: people the Owner invites to the Account, including staff who scan passes.
  • Pass: a digital card (loyalty card, membership, gift card, ticket, badge or similar) that you issue with Walletap for Apple Wallet, Google Wallet or Huawei Wallet, or as a printed or web version.
  • End users: your customers, members, guests or staff who receive a Pass or use a page we host for you.
  • Your content: everything you or your team members put into the Service, including designs, logos, texts, member data and messages.
  • Plan: the free plan or a paid plan, with the features and allowances described in section 5.
  • Location: a physical premises where your business serves its customers or members, such as a shop, café, restaurant, salon or gym. Each premises is one Location, whatever it is called in the Account and whether or not it has been added to the Account.
  • Active customer: a Pass that, in a calendar month, was issued, collected stamps or points, had a balance added or used, had a reward redeemed, or was scanned or checked in. Each Pass counts once a month. Notifications sent to Passes, event tickets and access badges do not count.
  • Wallet platforms: Apple Wallet, Google Wallet and Huawei Wallet, run by Apple, Google and Huawei. They are not parties to these Terms.

3. Your account

3.1. You sign in with a one-time link sent to your email address, with Sign in with Apple or Google, or with a password in the desktop app. Anyone who can read your email can sign in to your Account, so keep your email account secure.

3.2. Give us accurate details about you and your business, and keep them up to date. This includes the business name, country and, where you have one, the VAT number.

3.3. You are responsible for everything done in your Account, whether by you, by your team members, or through your API keys and connected integrations. Give each team member only the role they need. Remove access when someone leaves. Keep API keys secret, and revoke a key if it may have been exposed.

3.4. Each plan limits how many team members and devices can use the Account. One person's sign-in may be active on a limited number of devices. Do not share sign-ins to get around these limits. Each plan also covers a number of Locations: every Location where your end users receive or use Passes needs to be covered by your plan or an additional Location.

3.5. Tell us at support@walletap.com if you think someone has accessed your Account without permission. For sensitive actions, we may ask you to confirm your identity.

4. The Service

4.1. With Walletap you can:

  • design Passes;
  • issue Passes and deliver them by link, QR code, email or text message;
  • scan and validate Passes;
  • add stamps, points and visits and redeem rewards;
  • manage memberships;
  • send notifications to Passes;
  • view analytics;
  • and, where your plan includes them, take payments, fiscalise receipts, control doors and connect other systems.

4.2. You need a compatible device, a current browser or app version and an internet connection. Your end users need a phone that supports the wallet they use. We tell you about changes to these requirements in the Service or by email.

4.3. Passes live in wallet apps that belong to Apple, Google and Huawei, under their own terms. They decide what a Pass can do and how updates and notifications reach end users. They can change or withdraw features, or remove a Pass, and we cannot control that. We use their names only to say that Walletap works with their wallets; none of them sponsors or endorses Walletap.

4.4. We keep improving the Service. We may change or remove a feature for good reason, for example:

  • for security;
  • to comply with the law;
  • because a wallet platform or another supplier changed what it offers;
  • to fix errors;
  • or to replace a feature with a better one.

If a change noticeably reduces what your paid plan gives you, we tell you at least 30 days in advance. You may then cancel the plan before the change takes effect. If you paid on walletap.com, we refund the unused prepaid part of your fee.

5. Plans, limits and the free plan

5.1. Every Account is on a plan. The features and allowances of each paid plan are described on our website and in the app at the time you choose it. These include the number of card designs, Locations, companies, team members, devices and active customers a month and, where applicable, included message credit. Enterprise plans, hardware, installation and other add-ons are agreed with us separately.

5.2. The free plan lets you issue 25 Passes in total. This is a lifetime count for the Account, not a monthly one. It includes Passes issued during a free trial and does not reset. It also includes one card design and one Location. Passes issued on the free plan do not expire because of the plan.

5.3. Plan limits apply when you create something new. When you reach a limit, you cannot issue the next Pass or add the next card design, Location or team member until you change plan. Nothing you already have is deleted or switched off because of a limit: Passes already in your end users' wallets keep working.

5.4. When a paid plan ends, the Account moves to the free plan. Your card designs, Locations, members and Passes stay. What you can create from then on, and which paid features you can use (such as campaigns, paid messages and new API keys), follows the free plan. If you set up a payment connection, fiscalisation or a custom domain on a paid plan, you can keep using it after a plan change.

5.5. A plan belongs to the Account. It applies wherever you use Walletap (web, desktop and mobile), whether you bought it on walletap.com or in the mobile app.

5.6. Paid plans have no limit on the number of Passes. Each includes a number of active customers a month for every Location it covers, shown on our website and in the app, and the Service shows how many your Account has had this month. If your Account had more active customers than your plan includes in each of the last two complete calendar months, you cannot issue new Passes until you add Locations or change to a plan that covers them. You can issue new Passes again as soon as you do. Passes you have already issued keep working, and collecting, redeeming and scanning are never limited. Event ticket Passes, access badges and Passes issued when an end user buys a membership are not affected.

6. Free trial

6.1. The Owner of a new Account can start one free 30-day trial of the Loyalty Starter plan. It is offered in the app and in the dashboard. It never starts on its own.

6.2. The trial needs no payment method, costs nothing and does not turn into a paid plan. When it ends, the Account moves to the free plan. The 25-Pass total then counts the Passes issued during the trial. Team members you added during the trial stay, but you cannot add more beyond the free plan's limit.

6.3. During the trial:

  • the Account has the Loyalty Starter features;
  • paid message credit is not included;
  • you can send a small number of test messages to phone numbers you verify;
  • you can buy message credit packs in the app;
  • you get a limited number of AI designs.

6.4. The trial is available once per Account and once per email address. It is not available to accounts that have had a paid plan, whether on the web or in an app store, or that have a special arrangement with us. If you buy a plan during the trial, the paid plan and its billing start immediately. We may end a trial obtained by creating repeat accounts or by other abuse.

7. Paying on walletap.com

7.1. Plans bought in the dashboard are sold by Walletap. Payments are processed by Stripe; we do not see or store your full card details. You can pay by card and by the other methods shown at checkout. SEPA direct debit is available only by separate arrangement with us.

7.2. Prices on walletap.com are in euros and exclude VAT unless marked otherwise. VAT is added at checkout where it applies. An EU business that gives a valid VAT number is charged under the reverse-charge rule. If you buy as a Croatian business, choose the option to buy as a business and enter your VAT number (HR followed by your OIB). You are responsible for entering it correctly; without one, we treat the purchase as a purchase by a private person.

7.3. You receive:

  • an eRačun, if you are a Croatian business;
  • a fiscalised receipt, if you are a private person in Croatia or elsewhere in the EU;
  • otherwise, an invoice from our payment system.

Your invoices are listed in the dashboard under Settings > Billing.

7.4. Paid plans are monthly or yearly subscriptions. They renew automatically for the same period, at the price that applies at renewal, until you cancel. We charge your saved payment method at the start of each period. There is no minimum term beyond the period you have paid for.

7.5. Some plans include usage-based charges on top of the plan fee. These are messages beyond the included credit (section 9) and, on plans that include a number of active passes, the active passes above that number. They are charged monthly in arrears, including on yearly plans. On plans that charge for active passes, we count the highest number of Passes that were active at the same time during the month. A Pass is active when it has been added to a wallet or scanned, is valid, and has not been revoked or expired. The rates are shown on our website and in the Service before you incur them.

7.6. Moving from Loyalty Starter to Loyalty Business takes effect immediately; we charge the prorated difference for the rest of the period straight away. Moving to a smaller plan, or between monthly and yearly billing, takes effect at the end of the period you have paid for. For other plan changes, contact support@walletap.com.

7.7. The Owner can cancel at any time in the dashboard under Settings > Billing > Manage billing. The plan stays active until the end of the period you have paid for and then ends; there is no notice period. We do not refund the rest of a period you have already started, except where these Terms or the law say otherwise.

7.8. If a payment fails, the plan stays active while we retry it. If it still cannot be collected, the subscription ends and the Account moves to the free plan. For amounts a business owes us, we may charge statutory default interest.

7.9. We may change our prices, for example:

  • because our costs for hosting, messaging, wallet platforms or payment processing change;
  • because of taxes, inflation or exchange rates;
  • because of changes in the law;
  • because we add significant new features to a plan.

We tell you about a price change for your subscription by email at least 30 days before it applies to you. You may cancel before the new price applies. Until then you keep your current price. Message rates follow our suppliers' costs and may change sooner; the current rates are always shown in the Service before you send.

8. Paying in the mobile app

8.1. In the iPhone and Android apps, the Owner can buy Loyalty plans (monthly or yearly) and message credit packs. These are sold through the App Store or Google Play. In the EU, App Store purchases are sold by Apple Distribution International Ltd., and Google Play purchases by Google. Apple's or Google's terms apply to the payment, renewal, billing retries and refunds. The price is the one shown in the store, in your local currency and including any taxes. Walletap does not issue its own invoice for these purchases.

8.2. You pay through your Apple ID or Google account when you confirm the purchase. A store subscription renews automatically for the same period until you cancel it. To stop the next renewal, cancel before the renewal date; Apple asks you to do this at least 24 hours before the current period ends. After you cancel, the plan stays active until the end of the period you have paid for.

8.3. You manage or cancel a store subscription with Apple or Google, not with Walletap:

  • on iPhone or iPad: Settings > your name > Subscriptions, or at apps.apple.com/account/subscriptions;
  • on Android: in the Google Play app under Payments & subscriptions, or at play.google.com/store/account/subscriptions.

In the Walletap app, Settings > Plan & billing > Manage subscription opens the same place. Deleting the app, or deleting your Walletap Account, does not cancel a store subscription.

8.4. Refunds for App Store and Google Play purchases are decided by Apple and Google; Walletap cannot refund them. Apple takes refund requests at reportaproblem.apple.com; Google takes them through Google Play. If a subscription is refunded, the plan ends. If a message credit pack is refunded, its credit that has not been spent is removed; credit already spent on messages that were sent is not restored.

8.5. Changing between Starter and Business, or between monthly and yearly billing, follows the store's rules. On the App Store, a change to a higher plan takes effect immediately and a change to a lower plan at the next renewal. Google Play replaces the old subscription and credits the unused time.

8.6. A plan bought in the app belongs to the Walletap Account. The store subscription itself stays with the Apple ID or Google account that bought it. If you restore that purchase while signed in to a different Walletap Account, the plan moves to that Account. Buy with an Apple ID or Google account that will stay with your business.

8.7. An Account has one billing channel at a time. While a store subscription is active, the Account cannot also be subscribed on walletap.com, and the app does not sell plans to an Account that pays us directly. If an Account ends up paying in both places, the plan paid to Walletap directly applies and the store purchase adds nothing. Cancel the one you do not need where you bought it.

8.8. In-app purchases are available for the Loyalty plans and message credit packs. Other plans are arranged with Walletap directly. The desktop apps and the Huawei AppGallery version have no in-app purchases, but any plan on your Account applies to them.

8.9. If you got the app from the App Store, Apple's Licensed Application End User License Agreement governs your licence to use the app itself (apple.com/legal/internet-services/itunes/dev/stdeula/). These Terms govern your Account, the Service and your plan. Apple and Google are not parties to these Terms and are not responsible for the Service or its support; Walletap is (section 18).

9. Message credit, ticket credits and other usage

9.1. You can send your end users text messages (SMS), Viber and WhatsApp messages through Walletap. Notifications to Passes in a wallet are free and unlimited on every plan.

9.2. Messages are priced per message. The rate depends on the channel and the destination country, and SMS is charged per segment of up to 160 characters (70 for some alphabets). If a message cannot be delivered on one channel and we try the next, each attempt is charged. The current rates for your Account are shown in the messaging settings.

9.3. By default, a new Pass is sent automatically to the email address and phone number you enter for the end user, and a text message is charged like any other. You can choose the channels, and switch automatic sending off, in the messaging settings.

9.4. Message credit is an amount in euros that pays for messages:

  • Monthly credit. Loyalty plans include an amount of monthly credit. It is added at the start of each calendar month (UTC), is used first, and does not carry over to the next month.
  • Pack credit. Message credit packs bought in the app add credit that does not expire. It is used after the monthly credit.
  • Credit has no cash value. It cannot be transferred to another Account or paid out. It ends when the Account is deleted.
  • On the free plan and during the trial, messages go only to phone numbers you have verified, unless you have pack credit.

9.5. If you pay for your plan in the app and your credit runs out, paid messages stop until you buy a pack or the next month's credit arrives. If you pay on walletap.com, messages beyond your credit are charged as usage (section 7.5).

9.6. Event ticket Passes use ticket credits. Every Account receives a number of free ticket credits, and more can be bought on walletap.com in prepaid packs. Ticket credits do not expire and have no cash value. If a pack is refunded, its unused credits are removed.

9.7. Some features have fair-use allowances or rate limits, such as AI designs, the API and the MCP server. The allowances for your plan are shown in the Service.

10. Your responsibilities

10.1. You are the issuer of your Passes and the provider of your loyalty programme, memberships, offers, gift cards and tickets. You are responsible for what they promise, for honouring them, and for your relationship with your end users. Walletap is not a party to that relationship and does not guarantee what your Passes represent.

10.2. You must have a lawful basis for the end-user data you put into the Service and for every message you send. Where the law requires consent (for example for marketing messages), you must have it before you send. You tell end users how you use their data, in your own privacy notice and terms. On sign-up pages we host for you, you provide the consent text and the links to your own terms and privacy policy.

10.3. You are responsible for your prices, taxes, invoices and receipts for what you sell to your end users. You also remain responsible for fiscalising your sales where the law requires it, including when the Service does the fiscalisation for you (section 13.3).

10.4. You must follow the rules of the wallet platforms for your Passes. You must not issue Passes that act as electronic money, a payment instrument, a financial instrument or another regulated product, unless you comply with the rules that apply to it.

10.5. If you are a business, you will compensate Walletap for claims, fines and costs caused by:

  • your content;
  • your Passes;
  • your messages;
  • your breach of these Terms or of the law.

This includes claims from your end users and from wallet platforms.

11. Acceptable use

You must not:

  • break the law, or help anyone else break it;
  • infringe anyone's rights, including their intellectual property or privacy;
  • send spam or messages people have not agreed to receive where consent is required;
  • issue Passes that are misleading, fraudulent or that imitate another business or brand;
  • put unlawful, hateful, violent, sexually explicit or otherwise harmful content into Passes, pages or messages;
  • collect personal data without a lawful basis;
  • test, probe or attack the Service, try to reach data that is not yours, or get around security, rate limits or plan limits;
  • copy, decompile or reverse engineer the Service, except where the law allows it;
  • scrape the Service, or resell or sublicense it without our written agreement;
  • overload the Service or use it in a way that harms other customers;
  • use the Service if you, or the business you act for, are subject to EU, UN or US sanctions, or are in a country under a comprehensive embargo.

12. Content we host, reports and our decisions

12.1. We may refuse, restrict or remove a Pass, page or message, or restrict an Account, if:

  • it breaks these Terms, the law or a wallet platform's rules;
  • a wallet platform, a supplier or an authority requires us to act;
  • we need to protect end users, other customers or the Service.

We act on reports, on requests from wallet platforms and authorities, and on what our own checks find, and a person reviews the decision. When we act, we tell you what we did and why, unless the law does not allow us to or doing so would help someone cause harm.

12.2. Anyone can report content they believe is illegal or breaks these Terms. Email support@walletap.com with the link or the Pass, what is wrong and why. We review each report and tell the reporter what we decided.

12.3. If you disagree with a decision we made about your content or your Account, reply to our message or email support@walletap.com, and we will review it again and tell you the outcome.

12.4. support@walletap.com is also our contact point for authorities. We communicate in English and Croatian.

13. Payments you take from your customers

13.1. Where your plan allows it, you can sell memberships, tickets and other items to your end users. You connect your own Stripe account for this, and each company in your Account can use its own. You are the seller of what you sell. Payments go to your Stripe account under your own agreement with Stripe. You handle refunds, chargebacks, disputes and your terms of sale with your end users. Walletap is not a payment service provider and never holds your money.

13.2. Walletap does not currently charge a fee on the payments you take. If we introduce one, we will tell you at least 30 days in advance. It will apply only to payments made after that date.

13.3. If you use fiscalisation in the Service, we send your receipts to the tax authority using your own certificate and the data you enter. You remain the one who must fiscalise. You are responsible for a valid certificate and for correct business, premises and device details.

14. Door access and hardware

14.1. Door and access features let you open doors and admit end users with their Passes through a supported controller or reader installed at your premises. You are responsible for:

  • installing the hardware;
  • the safety and security of your premises;
  • emergency exits and fire regulations;
  • always having another way to open the door.

14.2. We do our best to make access decisions correctly and quickly, but we do not guarantee that a door will open or stay closed. This includes when the internet, a controller or the Service is unavailable, and when a controller decides on its own which cards to admit. Do not use Walletap as the only safeguard for people's safety.

14.3. We are not responsible for unauthorised, incorrect or fraudulent validations, check-ins or door openings made with NFC or QR codes, whether caused by end users, other people or the limits of the wallet platforms, except where section 20.4 applies.

14.4. Readers, controllers, physical cards, access badges, installation and hardware support are quoted and sold separately, under their own terms.

15. AI and automated features

15.1. Some features use artificial intelligence provided by third parties. One example is drafting a card design from your website, social media pages or uploaded images. You must have the right to use the material you point these features to. AI output can be wrong or incomplete, so review it before you publish it.

15.2. Automated features include logo background removal, text translation and receipt scanning. They can make mistakes. For example, receipt scanning does not prove that a receipt is genuine. You decide your own rules for stamps, points and rewards.

16. Data protection

16.1. For the personal data of the people who use your Account (you, your team members and your contact details), and for visitors to our website, Walletap is the controller. Our Privacy Policy explains how we use it.

16.2. For the personal data of your end users that you put into or collect through the Service, you are the controller and Walletap is your processor. This covers names, contact details, membership and visit data, and uploaded documents. The rest of this section is our data processing agreement under Article 28 of the GDPR. A separately signed data processing agreement prevails over it.

  • Subject matter, nature and purpose: hosting, storing, organising and transmitting end-user data to provide the Service. That means issuing and updating Passes, delivering them, sending messages, validating Passes, managing memberships, taking payments and fiscalising receipts, analytics and support.
  • Duration: for as long as we provide the Service to you, and then until the data is deleted under section 19.
  • Types of data: the data you choose to collect. Typically this means name, email address, phone number, Pass and membership details, visits, stamps and points, purchases, and photos or documents you ask end users to upload.
  • Data subjects: your customers, members, guests and staff.
  • Your instructions: we process the data only on your documented instructions. These Terms and your settings in the Service are those instructions. We tell you if we believe an instruction breaks data protection law.
  • Confidentiality and security: everyone who processes the data for us is bound to confidentiality. We apply appropriate technical and organisational measures.
  • Sub-processors: you authorise us to use sub-processors for hosting, email and message delivery, payments, wallet delivery, AI features, OCR, translation and support. We give each one data protection obligations equal to ours and remain responsible for them. We give you the current list on request. We tell you about a new sub-processor in advance, and you may object on reasonable grounds; if we cannot resolve the objection, you may end your subscription.
  • International transfers: we store data in the EU. If a sub-processor processes data outside the EEA, we use a lawful transfer mechanism such as the EU standard contractual clauses.
  • Assistance: we help you respond to requests from end users exercising their rights. We also help you with security, breach notification, impact assessments and consultations, taking into account the information available to us.
  • Personal data breaches: we notify you without undue delay after we become aware of a breach affecting your end-user data.
  • End of the Service: you can export your data at any time (section 19.4). After termination we delete it as described in section 19, unless the law requires us to keep it.
  • Audits: we give you the information you need to show compliance with Article 28. We allow audits on reasonable notice, at your cost, in a way that protects other customers' data.

16.3. End users can ask you, as controller, to exercise their data protection rights. If they contact us, we pass the request to you. End users can also complain to the Croatian Personal Data Protection Agency (AZOP) or to their local supervisory authority.

16.4. Analytics about wallets and Passes depend on what the wallet platforms make available. We cannot guarantee their availability or accuracy.

17. Intellectual property and licences

17.1. Walletap owns the Service, including its software, designs, documentation and trademarks, and all improvements to it. We grant you a limited, non-exclusive, non-transferable licence to use the Service and our apps for your business during your subscription, under these Terms. The Walletap desktop app for Windows is downloaded from walletap.com rather than from an app store; this licence covers it too.

17.2. Your content remains yours. You grant Walletap a licence to host, copy, process, display and transmit it, only as needed to provide and improve the Service for you. This licence lasts for as long as your content is in the Service.

17.3. Pages and Passes we host for you may show a small "Powered by Walletap" mark. You may mention that you use Walletap. Any other use of our name or logo needs our consent.

17.4. If you send us feedback or suggestions, we may use them freely and without payment to you.

18. Availability and support

18.1. We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service can be interrupted for maintenance, for updates, or by events outside our control. Examples are failures at internet providers, cloud and messaging suppliers or wallet platforms, power cuts, attacks and natural events. We are not responsible for delays or failures caused by such events.

18.2. Support is provided by Walletap, not by Apple, Google or Huawei. This applies to the apps too. Write to support@walletap.com. We usually reply within 24 hours on business days. Response times, availability commitments and service credits apply only if they are in a separate signed agreement.

18.3. We back up data regularly. You are still responsible for keeping your own copies of important data, which you can export at any time.

19. Cancellation, account deletion and termination

19.1. You can stop using the Service at any time. Paid plans are cancelled as described in section 7.7 (walletap.com) or section 8.3 (App Store and Google Play).

19.2. The Owner can delete the Account in the mobile app under Settings > Account > Delete account, in the dashboard under Settings > Account, or by writing to support@walletap.com from the Account's email address. We confirm the request by email and delete the Account 14 days later, so you can change your mind: until then, choose Keep my account in the dashboard. We complete deletion within 30 days of the request and confirm it by email. Before you delete:

  • cancel any App Store or Google Play subscription, because deleting the Account does not stop Apple or Google from charging you;
  • cancel any subscription on walletap.com;
  • note that unused credit ends when the Account is deleted (section 9.4).

19.3. Deleting the Account deletes its card designs, members, Passes and settings. Passes already in your end users' wallets may stay on their devices but are no longer updated or validated. We keep invoices, fiscal records and other data for as long as the law requires.

19.4. You can export your members and Passes as CSV files from the dashboard at any time. When your Account is terminated for any reason, we keep your data for 30 days so that you can export it, and then delete it.

19.5. We may suspend or terminate your Account, or part of the Service, if:

  • you do not pay amounts that are due;
  • you seriously or repeatedly breach these Terms;
  • you misuse the Service or endanger its security;
  • you infringe our intellectual property;
  • the law, an authority or a wallet platform requires it;
  • sanctions apply to you.

Where it is reasonable, we warn you first and give you time to fix the problem. When we act, we give you our reasons.

19.6. We may also end the Service for your Account for another reason, with at least 30 days' notice. If we do, we refund any fee you prepaid on walletap.com for the period after the end date.

19.7. Sections 10.5, 16 (for as long as we hold your end-user data), 17, 19 and 20, and every other provision that by its nature should survive, remain in force after termination.

20. Warranties and liability

20.1. We provide the Service with reasonable care and skill. Beyond what these Terms say and what the law requires, we give no warranties. In particular, we do not guarantee:

  • any business result;
  • that the Service will be uninterrupted or free of errors;
  • that it will work with every third-party system.

20.2. If you are a business, Walletap is not liable for:

  • indirect or consequential loss;
  • loss of profit, revenue, business, goodwill or data, beyond the cost of restoring data from our backups.

Our total liability to you for all claims in any 12-month period is limited to the higher of two amounts: what you paid for the Service in the 12 months before the event that caused the claim, or EUR 100.

20.3. Walletap is not liable for loss caused by:

  • the wallet platforms, your hardware, your internet connection or other third parties;
  • your content, your instructions or your breach of these Terms.

20.4. Nothing in these Terms excludes or limits liability for:

  • intent or gross negligence;
  • death or personal injury caused by negligence;
  • fraud;
  • anything else for which the law does not allow liability to be excluded or limited.

The limits in section 20.2 do not apply to consumers. Consumers keep all their statutory rights (section 21).

21. If you are a consumer

21.1. This section applies if you use the Service as a natural person for purposes outside your trade, business, craft or profession. It adds to the rest of these Terms and prevails where the two differ. Nothing in these Terms limits the rights you have under mandatory consumer law, including the law of the country where you live.

21.2. Right of withdrawal for purchases on walletap.com. You may withdraw from a subscription or credit pack bought on walletap.com within 14 days of the purchase, without giving a reason. To withdraw, use the Withdraw from contract here button in the dashboard under Settings > Billing, which is there for 14 days after each purchase. You can also send us a clear statement before the 14 days end, by email to support@walletap.com from your Account's email address or with the model form below. We confirm receipt by email straight away.

We refund everything you paid within 14 days of receiving your statement, to the payment method you used, free of charge. At checkout you tick a box asking for the Service to start straight away. Because you asked, you pay a proportionate amount for the days before you withdrew; for a credit pack, you pay for the credit you used.

21.3. Model withdrawal form. To: Walletap d.o.o., Nazorova ulica 60, 52100 Pula, Croatia, support@walletap.com. "I hereby give notice that I withdraw from my contract for the following service: [plan or pack]. Ordered on: [date]. Name: [your name]. Email address of the Account: [email]. Date: [date]."

21.4. Purchases in the App Store or Google Play are withdrawn through Apple or Google under their terms:

  • Apple: through your purchase history or reportaproblem.apple.com;
  • Google: through Google Play.

21.5. Conformity. Walletap is responsible for the Service conforming to these Terms throughout your subscription. If it does not, you may ask us to bring it into conformity. If we cannot do so within a reasonable time, you may ask for a proportionate price reduction or, unless the problem is minor, end the contract and receive a refund for the affected period.

21.6. Complaints. Send complaints to support@walletap.com or to our postal address. We confirm receipt without delay and reply in writing within 15 days. If we cannot resolve your complaint, our reply tells you which alternative dispute resolution body you can turn to and whether we will take part.

22. Text messages (SMS, Viber, WhatsApp)

This section is for the people who receive messages sent through Walletap, as well as for our customers.

22.1. Businesses that use Walletap send their customers text messages (SMS), Viber and WhatsApp messages through the Service. Examples are a link to add a Pass to their wallet, a notice that a Pass has changed, or other messages about their Pass or membership. Each message is sent on behalf of the business that issued the Pass and names it. The sender name may be "Walletap".

22.2. The business decides which messages to send and must have the recipient's consent where the law requires it. Consent to receive messages is never a condition of buying anything.

22.3. How often you receive messages depends on the business and on your Pass. Messages usually arrive when a Pass is issued or changes. Message and data rates from your mobile operator may apply.

22.4. To stop receiving messages:

  • in the United States and Canada, reply STOP; reply HELP for help;
  • in Serbia, send STOPWALLETAP to 1414, which is free of charge;
  • elsewhere, many messages come from a sender name that cannot receive replies, so contact the business that sent the message, or email support@walletap.com with your phone number and we will help you stop them.

Emails that deliver a Pass contain an unsubscribe link.

22.5. We do not sell phone numbers or text-message opt-in data, and we do not share them with third parties for their own marketing. Mobile operators are not liable for delayed or undelivered messages, and we cannot guarantee delivery.

23. Changes to these Terms

23.1. We may change these Terms. We may do so, for example:

  • to reflect changes to the Service, our plans or the law;
  • because of requirements from wallet platforms, app stores or suppliers;
  • for security;
  • to make the Terms clearer.

23.2. We notify you of a change that affects your rights or obligations at least 30 days before it takes effect. We do this by email to the Owner and in the Service. If you do not agree, you may cancel your plan and stop using the Service before the change takes effect, free of charge. If you paid on walletap.com, we refund the prepaid fee for the period after that date. If you continue to use the Service after that date, the changed Terms apply.

23.3. Changes that do not affect your rights or obligations can take effect when we publish them, for example corrections or clearer wording. Changes that the law requires us to make sooner can also take effect sooner. The date at the top shows the current version. Previous versions are available on request.

24. Governing law and disputes

24.1. These Terms are governed by the law of the Republic of Croatia. If you are a consumer, you also keep the protection of the mandatory rules of the law of the country where you live.

24.2. We will first try to resolve any dispute amicably; write to support@walletap.com. If you are a business, the court with subject-matter jurisdiction at Walletap's registered seat has exclusive jurisdiction. If you are a consumer, you may bring proceedings in Croatia or in the courts of the country where you live, and we may bring proceedings against you only there.

25. General

25.1. These Terms, the documents they refer to and any separate agreement under section 1.5 are the whole agreement between you and Walletap about the Service.

25.2. If a provision is invalid or unenforceable, the rest remain in force. The invalid provision is replaced by a valid one that comes as close as possible to its purpose.

25.3. If we do not enforce a provision straight away, we have not waived it.

25.4. You may not transfer your Account or these Terms without our consent. We may transfer them to a company that takes over the Service, if your rights are not reduced; we will tell you if we do.

25.5. These Terms are published in Croatian and English. You can view, save and print them here at any time. If the two versions differ, the Croatian version prevails.
